§ 1 Collection of Personal Data

(1) Please be advised that we will collect personal data when using our websites (www.ana-aqualine.de; www.bioboy.de) as well as for job applications. „Personal data“ are all data which are connected to you personally, e.g. name, address, email addresses, user behaviour.

(3) When contacting us by email or by our contact form, the data provided by you (your email address, possibly your name and phone number) will be collected by us in order to answer your questions. We will erase these data as soon as storage is no longer necessary, or will restrict processing of such data in case legal retention requirements exist.

(4) If we have to draw on service providers for particular features on our website, or shall use your data for promotional purposes, we will inform you below in detail about the respective procedure. We will also provide the criteria established for the storage period.

(5) Your data will be stored, especially for contractual requirements, as well as contacts necessary to enter into a contract, but also for direct marketing and customer care purposes (Art 6f DSGVO).

 (6) Your data will be stored according to the legal retention periods. If such a retention period does not exist, the data will be stored for a maximum of 24 months. Beyond that, we will store your data only if legitimate interests exist, such as contractual requirements.

§ 2 Your rights

(1) Referring to your personal data, you have the following rights against us:

  • –  right to rectfication or erasure,
  • –  right to restriction of processing,
  • –  right to object against processing,
  • –  right to data portability.

(2) You also have the right to raise a complaint at a data protection supervisory authority about us processing your personal data.

§ 3 Collection of personal data when visiting our website

(1) When using our website for information purposes only, which means you do not register or submit other information, we will only collect such personal data your browser is transmitting to our server. If you have a look at our website we will collect the following data, which are required technically in order to display our website and grant stability and safety (legal base is Art. 6 Para 1 p 1 lit f DS-GVO)

  • –  time zone difference to Greenwich Mean Time (GMT)
  • –  content of request (specific page)
  • –  access/HTTP-status code
  • –  data volume transferred
  • –  originating website

  • –  operating system and interface

(2) In addition to the data mentioned above, we use cookies when our website is being used. Cookies are small text files, saved on your computer and are assigned to the browser which you use. Certain information is provided to the operator placing the cookie (in this case us). Cookies cannot run programs or transmit viruses onto your computer. Their only purpose is to make the website more user-friendly and efficient.

 § 4 Further functions and offers of our website

(1) Besides using our website for information purposes, you may use additional functions we are offering. In order to do so you must provide further personal data, which we will use to fulfill our offer. The principles for data processing as indicated earlier also do apply.

 (2) For processing your data, we partially use external service providers. These providers were selected very carefully and commissioned by us. They are bound to our instructions and are checked on a regular basis.

 (3) Furthermore we may forward your personal data to third parties for participation in special sales, sweepstakes, contracts or similiar purposes, offered by us together with partners. We will provide further information regarding this subject, when collecting your personal data or below in the description of the corresponding offer.

 (4) If our service providers or partners are located in a country outside the European Economic Area (EEA) we will inform you about the consequences thereof in the description of our offer.

(5) This webisite is using so-called webfonts which are provided by Google (http://www.google.com/webfonts/). When visiting our website, your browser will load the necessary webfont to your browser cache. This is necessary, so your browser can also show a visually improved text. If your browser does not support this feature, a standard font will be used by your computer.

§ 5 Objection or Withdrawal of Processing Your Data

(1) If you have agreed to process your data, you may object at any time. Such an objection will affect the reliability of processing your personal data after you have informed us about it.

 (2) If we are supporting a balance of interest when processing your personal data, you may object against this processing. This may be the case, when processing your data is not necessary for contractual requirements which is shown in the following description of the functions. In case you object, we ask you to state the reasons why we are no longer allowed to process your personal data. We will examine the facts in case of a justified objection and will either stop or adapt processing your data, or will show you our compelling and worthy reasons to continue processing your data.

§ 6 Web Analytics

  • 1. Use of Google Analytics

 (1) Our company’s websites use Google Analytics, a web analytics service provided by Google Inc. („Google“). Google Analytics uses „cookies“, text files which are stored on your computer, and which enable an analysis of your use of the website. The information generated by the cookie concerning the use of this website is normally transmitted to a Google server in the USA and will be stored there. If IP anonymisation is activated on the website, your IP address will first be abbreviated by Google within the member states of the European Union or in other states that are part of the Agreement to the European Economic Area. In exceptional cases only, the complete IP address will be transmitted to a Google server in the USA and abbreviated there. By order of the operator of this website, Google will use this information to evaluate your use of this website. Google will then compile reports about website activities and provide additional services for the website operator regarding use of website and internet.

(2)  The IP address forwarded from your browser to Google Analytics will not be combined with other Google data.

(4)  This website uses Google Analytics with the extension „_anonymizeIp()“. IP addresses are being abbreviated before processing in order to prevent them from being directly linked to a particular person. In case the data collected from you can be linked directly to you, this will be excluded instantly and all individual-related data will be erased immediately.

(5)  We are using Google Analytics in order to analyse the use of our website and to improve it on a regular basis. We are able to improve our service for you as a user via the statistics made available. For exceptional cases, where personal data are being transmitted to the USA, Google subjected to EU-US Privacy Shield https://www.privacyshield.gov/EU-US-Framework. Legal basis for use of Google Analytics is Art. 6 Abs. 1 S. 1 lit. f DS-GVO.

§ 7 Participation in Application Process

If you apply by email for a job opening in our company via our website, we herewith inform you about your rights and how your data will be processed. We are processing and storing data provided by you for the application procedure.

Processing and storage are necessary for the application procedure as well as verification of suitability for the job opening and possibly further job openings in our company.

Legal base for data processing is § 26 BDSG. This regulation allows processing of data for establishment of an employment. After completion of the application procedure we will store your claims for securing effective prosecution. This is for securing defense against such claims and is our legitimate interest according to § 6 Ziff f) DSGVO

We will store your data for 6 months, and in our applicant pool for 2 year, if you agree. The data will be erased thereafter. In case you are chosen for the job opening, we will keep your personal data in our personnel administration.

The data is exclusively processed in data centers located in the Federal Republic of Germany.

Your rights correspond to § 2 and § 5 of the rights indicated above. You will find information about our data protection officer under § 1.
